ASYLUM

 

There are two types of Asylum, Humanitarian Asylum and Political Asylum.

 

Humanitarian Asylum is the practice of certain nations to accept onto their soil immigrants who have been forced to leave their country of origin due to the danger they faced due to racial or religious causes, wars, civil wars, natural disasters, famines.

 

Political Asylum is a way for people in danger of persecution or harm in their home country to achieve residency in the United States and ensure their safety.

The process requires an individual to demonstrate that there is a “reasonable fear” of personal safety if she returns to her home country.

Any person who fears, with grounds, that he may be persecuted or has already suffered persecution on the grounds of: his race, nationality, Religion, can apply for Political Asylum.

Applying for and obtaining Political Asylum allows foreigners to stay to live in the United States and gain legal status. Over time you can obtain a Green Card permanent residence and then, if desired, US citizenship.

The affirmative: This is when the Immigration and Citizenship Service is the one who decides.

The defensive: This is when it takes place in a court of law.

 

The most important benefit of winning an asylum case is that the foreigner acquires permanent residence, after being asylee, the foreigner will be able to apply for her permanent legal residence. Legal permanent residents can live and work in the United States.
